A shocking $14 million penalty has been imposed on City Beach, a well-known fashion retailer, for its failure to adhere to button battery safety standards. This decision, handed down by the Federal Court, highlights a serious breach of consumer law and a potential threat to the safety of young children.
Between June 2022 and October 2024, City Beach supplied over 54,000 products that did not meet the required safety standards for button batteries. Additionally, during the same period, more than 56,000 products were found to be non-compliant with the button battery information standard. These products, including toys, digital notepads, keyrings, lights, and Jibbitz accessories for Crocs, were often marketed towards children, increasing the potential risk.
The Court's observations were damning, noting City Beach's lack of awareness and compliance with its obligations as a retailer. Their conduct put over 50,000 young children at risk of severe injury or even death. The Court also criticized City Beach's slow response in recalling the non-compliant products, describing it as "condemnable."
"Today's penalty serves as a strong reminder to businesses that safety standards for button batteries are non-negotiable. The ACCC will take swift action against those who fail to prioritize consumer safety," said ACCC Commissioner Luke Woodward.
Button batteries, if swallowed or inserted, can have devastating consequences, especially for young children. In Australia, three tragic deaths have already occurred due to the ingestion or insertion of button batteries. Children under the age of 5 are particularly vulnerable to such hazards.
Australia's mandatory button battery standards, introduced in June 2022, aim to mitigate these risks. The safety standard requires products to have secure battery compartments, preventing children from accessing the batteries. The information standard mandates clear safety warnings and instructions for consumers.
This is the first court case brought by the ACCC for breaches of the button battery safety standards. The Court has ordered City Beach to implement a consumer law compliance program, undertake advertising as part of its product recall, and refrain from future contraventions of the Mandatory Standards.
The ACCC's action sends a clear message: consumer safety is paramount, and businesses must take responsibility for the products they supply.
